These Terms of Use ("Terms") govern your access to and use of the website at https://fosterhousestudio.com (the "Site"), operated by Aleksandar Toncev, trading as Foster House Studios ("we", "us", "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site. These Terms do not govern the licensing of any beat or instrumental — that is covered by the separate Beat License Agreements referenced in Section 5.

1. Who We Are

The Site is operated by Aleksandar Toncev, trading as Foster House Studios, Berlin, Germany. Full provider details and contact information are set out in our Impressum / Legal Notice. How we handle personal data is described in our Privacy Policy.

2. Eligibility and Acceptance

By using the Site you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into binding agreements. Your continued use of the Site constitutes acceptance of these Terms and of any updates published on this page.

3. Acceptable Use

You agree to use the Site lawfully and not to:

  1. copy, download (other than via functionality we expressly provide), scrape, mirror, rip, or redistribute any audio, stems, artwork, text, or other content from the Site;
  2. attempt to remove, circumvent, or defeat any watermark, producer tag, access control, or technical protection measure;
  3. use the Site or its content to train, fine-tune, or develop any machine-learning or AI model, or to build a dataset, without our prior written consent;
  4. use any beat, instrumental, preview, or other material in any recording, release, video, broadcast, performance, advertisement, or other project without a valid, paid licence (see Section 5);
  5. interfere with, overload, probe, or attempt to gain unauthorised access to the Site, its server, or its underlying systems;
  6. use the Site for any unlawful, infringing, defamatory, fraudulent, or harmful purpose;
  7. impersonate us or misrepresent your affiliation with us.

We may suspend or terminate your access to the Site at any time if you breach these Terms.

4. Intellectual Property

All content on the Site — including all beats, instrumentals, stems, recordings, mixes, masters, sound design, audio previews, artwork, graphics, logos, the "Foster House Studios" name and marks, text, and layout — is owned by or licensed to Aleksandar Toncev / Foster House Studios and is protected by copyright (Urheberrecht), trademark, and other intellectual-property laws. All rights are reserved. Nothing on the Site transfers or grants you any ownership of, or right to use, that content except as expressly stated in these Terms or in a signed/purchased licence.

5. Previews Grant No Licence

Streaming, previewing, or auditioning any beat or instrumental on the Site is provided for evaluation purposes only. It does not grant you any licence or right to use, download, copy, distribute, perform, broadcast, remix, or otherwise exploit that beat or instrumental in any way.

To obtain usage rights, you must enter into and pay for one of our beat licence agreements:

  • Basic License (MP3 Lease) — see license-basic;
  • WAV Lease — see license-wav;
  • Unlimited Lease — see license-unlimited;
  • Exclusive / Custom Agreement — see license-exclusive.

Each licence defines exactly what you may and may not do with the beat. In the event of any conflict between these Terms and a signed licence agreement, the licence agreement prevails with respect to the licensed beat.

6. Third-Party Links and Embeds

The Site may contain links to, or embeds from, third-party services (e.g. YouTube, SoundCloud, Spotify, Instagram). We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of them is at your own risk and subject to their terms.

7. No Warranty

The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Site will always be available, secure, or free of viruses or errors. This does not exclude any statutory rights that cannot be excluded under applicable law.

8. Limitation of Liability

Nothing in these Terms limits our liability for injury to life, body, or health, for intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), or for any liability that cannot be limited or excluded under mandatory law (including under the German Product Liability Act).

Subject to the above, we are liable for slight negligence (einfache Fahrlässigkeit) only in the event of a breach of a material contractual obligation (Kardinalpflicht), and in that case our liability is limited to the foreseeable damage typical of this type of transaction. We are not otherwise liable for slight negligence, and are not liable for indirect, consequential, or incidental damages, loss of profit, loss of data, or business interruption arising from your use of, or inability to use, the Site.

9. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the Site, or your unlicensed use of any content.

10. Changes to the Site and to These Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the current version is always posted on this page with the "last updated" date below. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and any conflict-of-law rules. Where you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

The place of jurisdiction for all disputes arising out of or in connection with these Terms is Berlin, Germany, to the extent permitted by law (in particular, this exclusive place of jurisdiction applies where you are a merchant, a legal entity under public law, or have no general place of jurisdiction in Germany).

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be replaced by a valid one that most closely reflects its intended purpose.
